General Terms and Conditions of ASSA ABLOY (Schweiz) AG for cooperation with recruiters
1. Scope
These General Terms and Conditions (GT&Cs) govern the conditions that apply when recruiting staff to ASSA ABLOY (Schweiz) through "recruiters".
Recruiters are defined as those who help with employee recruitment in Switzerland in accordance with the Swiss Federal Act on Employment Services. These provisions do not apply to personnel leasing within the meaning of the AVG or client relationships in which ASSA ABLOY (Schweiz) AG commissions a recruiter exclusively to fill a vacancy.
The contract between ASSA ABLOY (Schweiz) AG and the recruiter shall only come into effect upon acceptance of these General Terms and Conditions. When a candidate file is sent to ASSA ABLOY (Schweiz) AG by the recruiter, the recruiter fully acknowledges these GT&Cs.
The recruiter's General Terms and Conditions shall not apply.
2. Scope and obligations of the recruiter
The recruiter shall provided selection and recruitment services for management and specialist personnel for permanent positions for ASSA ABLOY (Schweiz) AG on a success basis. The rRecruiter has checked the candidate(s) proposed for a vacancy for suitability at least once in an interview before sending us a complete file (description of the candidate, CV, all certificates, diplomas and other documents for the application).
Additional services provided by the recruiter, such as advertisements in print or online media, assessments, suitability tests and personality analyses, as well as travel expenses, will only be remunerated by ASSA ABLOY (Schweiz) AG if this has been agreed in a separate contract.
3. Commission
ASSA ABLOY (Schweiz) AG shall only owe the recruiter the placement fee if an employment contract is concluded between ASSA ABLOY (Schweiz) AG and the candidate proposed by the recruiter.
The commission be paid is based on the gross annual salary contractually agreed with the candidate (fixed salary incl. 13th monthly wage). The fixed annual salary does not include (one-off) payments such as bonuses, severance payments, payments to pension fund contributions, expenses, etc.

The success fee is exclusive of VAT.
In the case of part-time contracts (less than 80%), the applicable fee rate is calculated based on the gross annual salary (including 13th monthly wage) under the hypothetical assumption of full-time employment. The commission is 2/3 of this value.
As soon as the commission is due, it shall be invoiced by the recruiter with a payment term of 60 days.
4. Exclusion of a commission
Where a candidate’s file is submitted by different recruiters for the same function, the one received first shall be taken into account, provided that the candidate has given his/her consent to the submission.
Furthermore, there is no entitlement to commission if the candidate introduced by the recruiter is hired[OB1] after three months.
5. Guarantee of success and reimbursement of the commission
If a referred candidate does not take up his/her position at ASSA ABLOY (Schweiz) AG or if the employment relationship is terminated for any reason within the contractually agreed probationary period, the recruiter must reimburse ASSA ABLOY (Schweiz) AG the following percentages of the commission within 30 days:

6. Data protection
The recruiter undertakes to maintain absolute discretion. Information shall only be forwarded with the written consent of ASSA ABLOY (Schweiz) AG or the candidate. Information that is generally accessible is not affected by this.
7. Applicable law/place of jurisdiction
7.1 These T&Cs shall be governed by Swiss law.
7.2 The place of jurisdiction for the contractual partners is Horgen.
8. Final provisions
The recruiter confirms that he/she has read these General Terms and Conditions and agrees to their content.
